Auction Terms and Conditions

1. Under the provisions of Civil Code Section 3072: All vehicles and their contents will be sold "AS IS" and all sales are final. The Company may state the year, make and model of vehicles, however, it is the responsibility of the buyer to ascertain by his/her own means the correctness of the vehicles year, make and model prior to bidding.
   
   
2. The buyer must register the vehicle with the Department of Motor Vehicles within 10 days after purchasing it. The buyer assumes full responsibility for transfer or ownership through the Department of Motor Vehicles.
   
   
3. Payment for vehicle is due immediately upon winning bid. No checks will be accepted for payment.
   
   
4. These vehicles have been appraised at $4000.00 dollars or less. Should the bid on these vehicles exceed $4000.00, said vehicles will be re-liened and sold at a later date under Civil Code Section 3071.
   
   
5. Prior to the registering of the vehicle with the Department of Motor Vehicles, do not drive or park the vehicle on a public street. Some of these vehicles have been impounded for excessive parking violations and expired registration. They can be impounded again if the D.M.V. records still show the expired registration or the unpaid citations. It is necessary to obtain new license plates and current registration. Old vehicle license plates are removed per California Civil Code section 3071 and 3072
   
   
6. Buyer is responsible for all D.M.V. fees, penalties and past due registrations; however, buyer Is not responsible for any outstanding parking citations.
   
   
7. The Company reserves the right to accept bids in any increment they feel is in the best interest of the sale all opening bids are taken from the floor.
   
   
8. All vehicles sold at sale are subject to City of Los Angeles 10% Parking Occupancy Tax, L.A. City Ordinance #165949, effective August 1st, 1990
   
   
9. All emission control equipment (smog) related repairs and certifications are the sole responsibility of the buyer. United Road Towing does not accept responsibility for the failure of any vehicle sold, or the failure of a vehicle to meet safety standards or emissions control equipment regulations as set by any Federal, State, or local agency. It is the express responsibility of the buyer to comply with any safety or emission control equipment requirements prior to using any vehicle purchased.
   
   
10. The Company and its representatives do not in any way guarantee the odometer reading to be actual, true, or correct. All vehicles sold through sale are sold "TRUE MILAGE UNKNOWN"'.
    
    
11. The Company reserves the right to bid on any vehicle. Any representative or employee of The Company bidding on vehicles will be introduced prior to the sale commencing.
    
    
12. If you are going to bid, be sure you have registered. Do not bid with someone else's number. If you do, your bid will be canceled. Each vehicle has a sale number, which corresponds to the number on your sale list. Before the company representative sells off each vehicle he/she will call out the vehicle's number and a description of that vehicle. Please make sure you bid on the correct vehicle. If you don't and you are the highest bidder you still must purchase that vehicle. If you do not purchase said vehicle you will be asked to LEAVE THE SALE!
    
    
13. Vehicles are to be removed from the lot immediately after the sale has been completed. However, before the vehicle is removed, the buyer must come to the office and sign paperwork in order to finalize the sale and transfer of title. All documents will be issued and called by bidder number. Any vehicles not removed from the lot by 12:00 PM the next day will be subject to the current storage rate set by the City of Los Angeles for storage at an Official Police Garage plus Parking Occupancy Tax.
    
    
14. In the event of incorrect paperwork the company will not be liable for repairs made to the vehicle before the D.M.V. registration process has been completed. ONLY the purchase price and the parking tax will be refunded.
    
    
15. There is absolutely no working on vehicles in the yard. Only one person will be allowed into the yard. NO EXCEPTIONS!
    
    
16. Any person who removes parts or property from a vehicle will be subject to arrest and/or expulsion from the sale.
    
    
17. Serialized Government issued identification is required to enter the Lien Sale.
    
    
18. Any employee of the City of Los Angeles is required to note that they are employed by the city when registering and shall notify a United Road Towing employee when a purchase has been made.
    

TERMS OF SALE FOR VEHICLES APPRAISED OVER $4,000.00 PER CIVIL CODE SECTION 3071

Although vehicles must be paid in full the day of purchase, there is a 10 Day redemption period in which the vehicle must remain at the company.

(k) Within 10 days after the sale of any vehicle pursuant to this section, the legal or registered owner may redeem the vehicle upon the payment of the amount of the sale, all costs and expenses of the sale, together with interest on the sum at the rate of 12 percent per annum from the due date thereof or the date when that sum was advanced until repayment. If the vehicle is not redeemed, all lien sale documents required by the department shall then be completed and delivered to the buyer.

Paperwork will be delivered to the buyer after 2 P.M. at 7817 Woodley Ave., Van Nuys, CA 91406 on the 10th day following the sale

1. Segun lo dispuesto en el Codigo Civil Seccion 3072: Todos los vehiculos, incluyendo su contenido, seran vendidos "TAL COMO ESTAN" y Ia venta sera definitiva. (Ia compania) debora establecer el ano, Ia marca y el modelo de los vehiculos, sin embargo, el comprador es responsable de constatar por sus propios medios Ia veracidad de tal informacion, antes de ofertar.
   
   
2. El comprador debe registrar el vehiculo en el Departamento de Vehiculos Automotores dentro de 10 dias despues de Ia compra. El comprador assume total responsabilidad de registrar el traspaso de propiedad en el Departamento de Vehiculos Automotores
   
   
3. El pago de vehiculo se debe immediatamente despues de Ia oferta ganadora. No cheques seran aceptados para el pago.
   
   
4. Estos vehiculos han sido ovaluados en $4000.00 o menos Segun Ia Seccion 3071 del Codigo Civil, si Ia licitacion por los vehiculos excede a los $4000 00
   
   
5. No conduzca ni estacione el vehiculo en una calle publica sin antes registrarlo on el Departamento de Vehiculos Automotores. Algunos de estos vehiculos han sido confiscados por violaciones excesivas de estacionamiento y por registro vencido. Pueden nuevamente ser confiscados si el registro del D.M.V. aun muestra el registro vencido o las citas no pagadas. Es necesario obtener nuevo permiso de placas y el registro vigente. Las placas viejas de los vehiculos son retiradas segun las secciones 3071 y 3072 del Codigo Civil de California.
   
   
6. El comprador es responsable de todos los cargos de D.M.V., multas y cuotas vencidas de inscripciones; sin embargo, no es responsable de ninguna cita pendiente por parqueo.
   
   
7. La Compania se reserve el derecho de aceptar los incrementos en las ofertas que considere de interes para el evento de ventas. Todas las ofertas iniciales se reciben en el Iugar de Ia venta.
   
   
8. Todos los vehiculos vendidos pagaran 10% del Uso de Estacionamiento de La Ciudad de Los Angeles., ordenanza #165949 de Ia Ciudad de LA, en vigor desde agosto 1°., 1990
   
   
9. Toda reparacion del equipo de control de emisiones (smog) y las certificaciones son total responsabilidad del comprador. La Compania no es responsable por fallas en cualquier vehiculo vendido, ni por fallas en el cumplimiento de las normas estandar de seguridad o de las regulaciones del equipo de control de emisiones establecidas por el Estado Federal o par una agencia local. Es responsabilidad expresa del comprador el cumplimiento de todo requerimiento de seguridad o el control de emisiones antes de poner en usa el vehiculo comprado.
   
   
10. La compania y sus representantes, de ninguna manera garantizan Ia veracidad en Ia lectura del odometro. Todos los vehiculos vendidos en el evento son negociados como "MILLAJE REAL DESCONOCIDO".
    
    
11. La compania se reserva el derecho de licitar cualquier vehiculo. Cualquier representante o empleado de La compania que presente oferta por vehiculos sera presentado antes de que inicie Ia venta.
    
    
12. Si va a presentar ofertas, debe registrarse. No haga ofertas con el numero de otra persona. Si lo hace, su oferta sera anulada. Cada vehiculo tiene un numero de venta que corresponde al numero de su lista. Antes de que el representante de Ia compania finalice Ia venta de un vehicu!o, el/ella anunciara el numero del vehiculo y Ia descripcion del mismo. Asegurese de hacer su oferta por el vehiculo correcto. Si no lo hace y usted es el mayor postor, tendra que comprar tal vehiculo. Si no compra dicho vehiculo, se le pedira que ABANDONE EL LUGAR!
    
    
13. Los vehiculos deben ser retirados del lote en cuanto se finalice Ia venta. Sin embargo, antes de retirar el vehiculo, el comprador debe llegar a Ia oficina y firmar los documentos de Ia venta y realizar Ia transferencia de propiedad. Se emitiran todos los documentos y se llamara por numero de oferente. Cualquier vehiculo que no sea retirado del lote antes de las 12:00 pm del dia siguiente estaran sujetas a Ia tasa actual de almacenamiento establecido por Ia Ciudad de Los Angeles por almacenaje en un Garaje Oficial de Policia mas el Impuesto por Usa de Estacionamiento
    
    
14. Si hubiere error en Ia documentacion, Ia compania no tendra responsabilidad legal por reparaciones realizadas antes de completar el proceso de registro del vehiculo en el D.M.V. Se devolvera SOLAMENTE el precio de Ia compra y el impuesto de estacionamiento.
    
    
15. No es permitido trabajar en los vehiculos dentro del lote. Se permitira solo una persona en el lote. iNO HAY EXCEPCIONES!
    
    
16. Cualquier persona que saque partes o bienes de algun vehiculo sera sujeto de ser arrestada y/o de ser expulsada de Ia venta
    
    
17. Se requiere pormiso emitido por el gobierno para entrar al evento de venta.
    
    
18. Se requiere Cualquier empleado de Ia Ciudad de Los Angeles senalar que estan al servicio de Ia ciudad cuando se registre y se notifique a un empleado de United carretera Remolque cuando se ha hecho una compra.
    

Condiciones de venta para vehiculos evaluados en mas de $4000.00 conforme a Ia secci6n 3071 del codigo civil

Aunque los vehiculos deberan ser pagados en su totalidad al momento de Ia compra, hay un periodo de rescate de 10 dias, durante el cual el vehiculo debe permanecer en Ia compania.

(k)En un plazo de 10 dias despues de Ia venta, de conformidad con esta seccion, el propietario legal o registrado debe retirar el vehiculo mediante el pago de Ia venta, los costos y gastos de Ia misma, mas los correspondientes intereses del 12 por ciento anual a partir de la fecha de vencimiento, o de la fecha en que tal suma fue pagada por anticipado hasta el pago total. Si el vehiculo no es retirado, todos los documentos de Ia obligacion requeridos se completaran y seran entregados al comprador.

La documentacion sera entregada al comprador despues de las 2 P.M. en 7817 Woodley Ave. Van Nuys, CA 91406 en el decimo dia despues de Ia venta.

Si por cualquier razon, algun parrafo, oracion, clausula o palabra de este documento es declarado invalido, tal declaracion no afectara ni anulara el resto de este documento.
